डॉ. कफील खान के खिलाफ एनएसए के तहत लगाए गए आरोप

इलाहाबाद हाईकोर्ट ने सरकार को तुरंत रिहा करने के निर्देश जारी किए
कफील खान को एक बड़ी राहत देते हुए मंगलवार को सरकार को उन्हें तुरंत रिहा करने का निर्देश दिया गया है। यह
आदेश डॉ. कफील खान की मां नुजहत परवीन द्वारा दायर एक बंदी प्रत्यक्षीकरण याचिका में आया है जिसमें आरोप
लगाया गया था कि उनके बेटे को अवैध रूप से हिरासत में लिया गया है और उनकी तुरंत रिहाई की मांग की गई
मथुरा जेल में बंद थे , उनके खिलाफ एनएसए के आरोपों को रद्द कर दिया है। 'डॉ कफील खान
का भाषण घृणा या हिंसा को बढ़ावा नहीं देता, यह राष्ट्रीय अखंडता और नागरिकों की एकता का आह्वान करता है':
इलाहाबाद हाईकोर्ट जिला मजिस्ट्रेट, अलीगढ़ द्वारा एनएसए अधिनियम के तहत 13 फरवरी, 2020 को पारित किए गए
हिरासत के आदेश और उत्तर प्रदेश राज्य द्वारा की गई पुष्टि को निरस्त कर दिया है। डॉ. कफील खान को हिरासत में
के बीच 13 दिसंबर, 2019 को अलीगढ़ मुस्लिम विश्वविद्यालय में एक भड़काऊ भाषण देने के लिए इस साल जनवरी में
मुंबई के एअरपोर्ट से गिरफ्तार किया गया था। खंडपीठ ने एनएसए के तहत डॉ. खान के खिलाफ कार्यवाही के मूल
रिकॉर्ड पर गौर करने के बाद मामले में फैसला सुरक्षित रख लिया था। गौरतलब है कि 29 जनवरी को डॉ. कफील को
यूपी एसटीएफ ने भड़काऊ भाषण के आरोप में मुंबई से गिरफ्तार किया था। 10 फरवरी को अलीगढ़ सीजेएम कोर्ट ने
जमानत के आदेश दिए थे लेकिन उनकी रिहाई से पहले NSA लगा दिया गया और वो जेल से रिहा नहीं हो पाए।
उन पर अलीगढ़ में भड़काऊ भाषण और धार्मिक भावनाओं को भड़काने के आरोप लगाए गए है ।
ए के तहत केस दर्ज किया गया है । आरोप है कि 12 दिसंबर को अलीगढ़ मुस्लिम यूनिवर्सिटी के छात्रों के सामने
दिए गए संबोधन में धार्मिक भावनाओं को भड़काया और दूसरे समुदाय के प्रति शत्रुता बढ़ाने का प्रयास किया।
वर्तमान बंदी प्रत्यक्षीकरण याचिका डॉ. कफील खान की मां नुजहत परवीन ने दाखिल की है। उन्होंने इस साल मार्च
में पहली बार सुप्रीम कोर्ट का दरवाजा खटखटाया था, जिसमें उसके बेटे को रिहा करने की मांग की गई थी। हालांकि,
सीजेआई एस ए बोबडे, जस्टिस सूर्यकांत और जस्टिस बीआर गवई की एक पीठ ने इस दलील पर कहा था कि
इलाहाबाद उच्च न्यायालय इस मामले से निपटने के लिए उपयुक्त मंच है इसके बाद, उच्च न्यायालय ने 1 जून, 2020

खान पहली बार खबरों में आए थे। शुरू में सूचित किया गया था कि उन्होंने अपनी जेब से भुगतान करके
आपातकालीन ऑक्सीजन की आपूर्ति की व्यवस्था करने के लिए तुरंत कार्रवाही करके एक उद्धारकर्ता के रूप में काम
किया है। बच्चों के लिए गैस सिलेंडरों की व्यवस्था करने में नायक माने जाने के बावजूद
, उन्हें भारतीय दंड संहिता की धारा धारा 409 (लोक सेवक द्वारा विश्वास का आपराधिक उल्लंघन ), 308 ( गैर इरादतन
हत्या का प्रयास) और 120-बी (आपराधिक साजिश) के तहत दर्ज एफआईआर में नामजद किया गया था। यह
आरोप लगाया गया था कि उन्होंने अपने कर्तव्यों में लापरवाही की थी जिसके परिणामस्वरूप ऑक्सीजन की कमी
हुई। उन्हें सितंबर 2017 में गिरफ्तार किया गया था, और अप्रैल 2018 में ही रिहा कर दिया गया था, जब उच्च
न्यायालय ने यह देखते हुए कि व्यक्तिगत रूप से डॉ. कफील खान के खिलाफ चिकित्सा लापरवाही के आरोपों को
स्थापित करने के लिए कोई सामग्री मौजूद नहीं है, उनकी जमानत अर्जी को अनुमति दे दी थी। उन्हें पद पर
लापरवाही बरतने आरोप में सेवा से भी निलंबित कर दिया गया था। विभागीय जांच की एक रिपोर्ट में उन्हें सितंबर
2019 में आरोपों से मुक्त कर दिया गया।@Nayak1

The Allahabad High Court gave a major relief to
Dr. Kafeel Khan, who was detained under the stringent provisions of the
National Security Act, 1980 (NSA), on 1st sep 2020, directing the government to
release him immediately. The order comes in a habeas corpus petition filed by
Dr Kafeel Khan's mother Nuzhat Parveen alleging that his son has been illegally
detained and demanded his immediate release.
A bench of Chief Justice Govind Mathur and Justice Soumitra Dayal Singh has quashed the NSA's charges against Dr. Kafeel Khan, who was currently lodged in Mathura jail. 'Dr. Kafeel Khan's speech does not promote hatred or violence, it calls for national integrity and unity of citizens': Detention orders passed by the Allahabad High Court District Magistrate, Aligarh under the NSA Act on February 13, 2020 and Confirmation made by the state of Uttar Pradesh has been rejected. The extension of the period of detention of Dr. Kafeel Khan has also been declared illegal..
Presently, Dr. Kafeel Khan is lodged in the Mathura Jail under the National
Security Act. He was arrested from Mumbai's airport in January this year for
allegedly delivering a provocative speech at Aligarh Muslim University on 13
December 2019 amid protests from CAA. The bench reserved the judgment in the
case after taking into consideration the original record of proceedings against
Dr. Khan under the NSA. Significantly, on January 29, Dr. Kafeel was arrested
by the UP STF from Mumbai on charges of provocative speech. On 10 February, the
Aligarh CJM court ordered bail but before his release NSA was imposed and he
could not be released from jail. He has been accused of inciting inflammatory
speech and religious sentiments in Aligarh.
A case under Section 153-A has been registered
against him in Aligarh on 13 December 2019 for spreading hatred on the basis of
religion, race, language. It is alleged that in an address given to the
students of Aligarh Muslim University on 12 December, they instigated religious
sentiments and tried to increase hostility towards other communities. The
present habeas corpus petition has been filed by Dr. Kafeel Khan's mother
Nuzhat Parveen. He had approached the Supreme Court for the first time in March
this year, demanding that his son be released. However, a bench of CJI SA
Bobde, Justice Suryakant and Justice BR Gavai had said on the plea that the
Allahabad High Court is the appropriate forum to deal with the matter.
Subsequently, the High Court heard the matter on June 1, 2020. .
However, after granting several adjournments at
the request of the petitioner's counsel, the court listed it on August 19, 2020
for final disposal order. In August 2017, Dr. Kafeel Khan was in the news for
the first time in the case of death of about 60 infants due to lack of oxygen
supply at Baba Raghav Das (BRD) Medical College Hospital in Gorakhpur. It was
initially reported that he acted as a savior by taking immediate action to
arrange emergency oxygen supplies by paying out of his own pocket. Despite
being considered a hero in arranging gas cylinders for children, he is charged
under sections 409 (criminal breach of trust by public servant), 308 (attempt
to commit culpable homicide) and 120-B (criminal conspiracy) of the Indian
Penal Code. Was named in the FIR registered under. It was alleged that he was
negligent in his duties resulting in lack of oxygen. He was arrested in
September 2017, and was released only in April 2018, when the High Court noted
that no material existed to personally establish allegations of medical
negligence against Dr. Kafeel Khan. Hai, his bail application was allowed. He
