जेलों में जिंदगी : 69 प्रतिशत मूलनिवासी अदालत से सजा नहीं मिलने के बाद भी जेलों में बंद

राष्ट्रीय अपराध रिकॉर्ड ब्यूरो (एनसीआरबी) ने साल 2019 में देश की जेलों में बंद कैदियों के आंकड़ों से जुड़ी एक रिपोर्ट
जारी की थी। इस रिपोर्ट के अनुसार देश की जेलों में बंद 4,78,600 कैदियों में से 3,15,409 (कुल 65.90 फीसदी) कैदी
अनुसूचित जाति, अनुसूचित जनजाति और अन्य पिछड़ा वर्ग
श्रेणियों के हैं.
गृह राज्य मंत्री जी किशन रेड्डी ने बुधवार को
राज्यसभा को एक प्रश्न के लिखित उत्तर में यह जानकारी उपलब्ध कराई. उन्होंने बताया
कि यह आंकड़े राष्ट्रीय अपराध रिकॉर्ड ब्यूरो द्वारा, 31 दिसंबर 2019 तक अद्यतन किए
गए आंकड़ों के संकलन पर आधारित हैं. उन्होंने बताया कि देश की जेलों में बंद 4,78,600 कैदियों में से 3,15,409 कैदी अनुसूचित
जाति, अनुसूचित जनजाति और अन्य पिछड़ा वर्ग
श्रेणियों के हैं जबकि शेष 1,26,393 कैदी अन्य
समूहों से हैं.
रेड्डी ने बताया कि आंकड़ों के अनुसार,
1,62,800 कैदी (34.01 फीसदी) अन्य पिछड़ा वर्ग के हैं जबकि 99,273 कैदी (20.74 फीसदी)
अनुसूचित जाति से और 53,336 कैदी (11.14 फीसदी)
अनुसूचित जनजाति से हैं. उन्होंने बताया कि कुल 4,78,600 कैदियों में से 4,58,687 कैदी (95.83 फीसदी) पुरुष और 19,913 कैदी (4.16 फीसदी) महिलाएं हैं.
एनसीआरबी की इस रिपोर्ट के अलावा एक अन्य रिपोर्ट
में यह बात सामने आई है कि भारत की जेलों में बंद 69 प्रतिशत कैदी विचाराधीन हैं. इसका अर्थ यह हुआ कि भारत की जेलों
में बंद हर दस में से सात कैदी अंडरट्रायल हैं. यह वे बंदी हैं, जिन्हें अदालत से सजा नहीं मिली है, लेकिन जेल में बंद हैं. यह कैदी ट्रायल प्रक्रिया पूरी होने का
इंतजार कर रहे हैं. ऐसे में संभावना
है कि इनमें से कई कैदी बरी होकर बाहर आ जाएं. हालांकि, धीमी न्यायिक प्रक्रिया, संसाधनों की
कमी की वजह से इन्हें अपनी जिंदगी जेल में गुजारनी पड़ रही है. यह बात इंडिया जस्टिस रिपोर्ट 2020 के अध्ययन में सामने आई है. हाल ही में टाटा ट्रस्ट ने कुछ अन्य संस्थानों के सहयोग से
इंडिया जस्टिस रिपोर्ट-2020 जारी की है.
यह रिपोर्ट देश के अलग-अलग राज्यों की न्याय करने की क्षमता का आकलन करती है.
जेलों में एससी, एसटी और मुस्लिमों की संख्या देश में उनकी आबादी के अनुपात से
अधिक!

की जेलों में बंद कैदियों से जुड़े आंकड़े जारी किए हैं, जिनसे पता चलता है कि जेलों में बंद अनुसूचतिच जाति, आदिवासियों और मुस्लिमों की संख्या देश में उनकी आबादी के
अनुपात से अलग है. जबकि, उच्च जाति से
जुड़े लोगों के मामले में ऐसा नहीं है.
इंडियन एक्सप्रेस की रिपोर्ट के मुताबिक, साल 2019 के आंकड़ों से
पता चलता है कि इन हाशिए पर खड़े समूहों में से मुस्लिम ऐसा समुदाय है, जिससे जुड़े जेल में बंद कैदी दोषियों के बजाय विचाराधीन अधिक
हैं. साल 2019 के अंत में देशभर की जेलों में कैद सभी
दोषियों में से अनुसूचित जाति 21.7 फीसदी हैं.
जेलों में बंद विचाराधीन कैदियों में अनुसूचित जाति से जुड़े लोगों की संख्या 21 फीसदी है. जबकि, 2011 के जनगणना के
अनुसार देश में इनकी आबादी 16.6 फीसदी है.
वहीं जेलों में बंद दोषियों में से अनुसूचित जनजाति से जुड़े लोगों की संख्या 13.6 फीसदी है, जिनमें से 10.5 फीसदी विचाराधीन कैदी हैं. जबकि, 2011 की जनगणना में इनकी आबादी 8.6 फीसदी थी.
इसके साथ ही 14.2 फीसदी की
आबादी के साथ दोषी ठहराए गए मुस्लिमों की संख्या 16.6 फीसदी है लेकिन इनमें से 18.7 फीसदी
विचाराधीन कैदी हैं. हालांकि एससी और एसटी के मामले में दोषी से विचाराधीन का यह
अनुपात उलट है. पुलिस रिसर्च एंड डेवलेपमेंट के पूर्व ब्यूरो चीफ एनआर वासन का
कहना है, इन आंकड़ों से पता चलता है कि हमारी आपराधिक
न्यायिक प्रणाली न सिर्फ धीमी है बल्कि इसमें गरीबों के खिलाफ मामले भरे पड़े हैं.
जो लोग अच्छे वकील रख सकते हैं, उन्हें आसानी
से जमानत मिल जाती है और न्याय भी मिल जाता है लेकि गरीब आर्थिक रूप से कमी की वजह
से छोटे-छोटे अपराधों में ही फंसा रह जाता है.
राज्यवार तरीके से देखें, तो जेलों में बंद अनुसूचित जाति विचाराधीन कैदियों की सबसे अधिक
संख्या उत्तर प्रदेश (17,995) में है. इसके
बाद बिहार में 6,843 और पंजाब में 6,831 है. वहीं अनुसूचित जाति के अधिकतर विचाराधीन कैदी मध्य प्रदेश (5,894) में हैं. इसके बाद उत्तर प्रदेश में 3,954 और छत्तीसगढ़ में 3,471 हैं. वहीं
सबसे अधिक मुस्लिम विचाराधीन कैदियों की संख्या उत्तर प्रदेश (21,139) में हैं. इसके बाद बिहार में 4,758 और मध्य प्रदेश में 2,947 हैं. ठीस इसी
तरह के विश्लेषण में जेल में बंद सबसे अधिक अनुसूचित जाति के दोषी कैदियों की
संख्या उत्तर प्रदेश (6,143) में हैं. इसके
बाद मध्य प्रदेश (5,017) और पंजाब (2,786) हैं.
यही नहीं जेलों में बंद सबसे अधिक आदिवासी दोषियों
की संख्या मध्य प्रदेश (5,303) में है. इसके
बाद छत्तीसगढ़ में 2,906 और झारखंड में
1,985 आदिवासी दोषी पाए गए हैं. इसी तरह से उत्तर
प्रदेश की जेलों में सबसे अधिक मुस्लिम कैदी हैं, जिन्हें दोषी ठहराया गया है. इनकी संख्या 6,098 है. इसके बाद पश्चिम बंगाल में ऐसे 2,369 और महाराष्ट्र में 2,114 कैदी हैं. @Nayak 1

In 2019, the National Crime Records Bureau
(NCRB) released a report related to the statistics of prisoners lodged in jails
of the country. According to this report, out of 4,78,600 prisoners lodged in
jails of the country, 3,15,409 (65.90 per cent of the total) inmates belong to
Scheduled Castes, Scheduled Tribes and Other Backward Class categories.
Minister of State for Home Affairs Kishan Reddy
made this information available in a written reply to the Rajya Sabha on
Wednesday. He said that these figures are based on the compilation of data
updated by the National Crime Records Bureau, till 31 December 2019. He said
that out of 4,78,600 prisoners lodged in jails of the country, 3,15,409 inmates
belong to the Scheduled Castes, Scheduled Tribes and Other Backward Class
categories, while the remaining 1,26,393 inmates are from other groups.
Reddy said that as per the data, 1,62,800
inmates (34.01 per cent) belong to Other Backward Classes while 99,273 inmates
(20.74 per cent) are from Scheduled Caste and 53,336 inmates (11.14 per cent).

Apart from this NCRB report, another report has
revealed that 69 percent of the prisoners in India's jails are under
consideration. This means that seven out of every ten prisoners in India's
jails are under trial. It is those prisoners who have not been sentenced by the
court, but are in jail. These prisoners are waiting for the trial process to be
completed. There is a possibility that many of these prisoners come out
acquitted. However, due to slow judicial process, lack of resources, they have
to spend their lives in jail. This is revealed in the India Justice Report 2020
study. Recently, Tata Trust has released India Justice Report -2020 in
collaboration with some other institutions. This report assesses the ability of
different states of the country to do justice.
The number of SC, ST and Muslims in jails is
more than the proportion of their population in the country!
The National Crime Records Bureau (NCRB) has
released data related to prisoners lodged in jails of the country, which shows
that the number of scheduled castes, tribals and Muslims in jails is different
from the proportion of their population in the country. However, this is not
the case with people belonging to the upper caste.
According to the report of Indian Express, the
data for the year 2019 shows that among these marginalized groups, there is a
Muslim community, in which the prisoners in jail are more under consideration
rather than convicts. At the end of 2019, SCs constitute 21.7 percent of all
convicts imprisoned in jails across the country. The number of people belonging
to Scheduled Castes is 21 percent of the undertrials lodged in jails. However,
according to the 2011 census, their population in the country is 16.6 percent.
At the same time, out of the convicts in jails, the number of people belonging
to Scheduled Tribes is 13.6 percent, of which 10.5 percent are undertrials.
However, their population was 8.6 percent in the 2011 census.
With this, 16.6 per cent of the convicted
Muslims with a population of 14.2 per cent, but 18.7 per cent of them are
undertrials. However, in the case of SC and ST, this ratio of convict to trial
is opposite. According to NR Vasan, former Bureau Chief of Police Research and
Development, these figures show that our criminal judicial system is not only
slow but there are cases against the poor in it. Those who can hire good
lawyers easily get bail and also get justice, but the poor are trapped in small
crimes due to lack of financial support.
In a state-wise manner, Uttar Pradesh (17,995)
has the highest number of under-scheduled caste prisoners in jails. This is
followed by 6,843 in Bihar and 6,831 in Punjab. At the same time, most of the
under-scheduled caste prisoners are in Madhya Pradesh (5,894). After this there
are 3,954 in Uttar Pradesh and 3,471 in Chhattisgarh. At the same time, Uttar
Pradesh (21,139) has the highest number of Muslim undertrials. After this there
are 4,758 in Bihar and 2,947 in Madhya Pradesh. In a similar analysis, Uttar

jails have the highest number of Muslim prisoners who have been convicted.
