केंद्रीय सूचना आयोग में सभी रिक्त पदों पर अभी तक नहीं हुईं नियुक्तियां : आरटीआई

सूचना आयुक्तों (आईसी) की नियुक्ति में देरी के खिलाफ सुप्रीम कोर्ट में याचिका दायर करने वाले दो याचिकाकर्ताओं ने केंद्रीय सूचना आयोग (सीआईसी) के मुख्य सूचना आयुक्त के तौर पर यशवर्धन कुमार सिन्हा की नियुक्ति का स्वागत किया है. सिन्हा को शनिवार को राष्ट्रपति रामनाथ कोविंद ने पद की शपथ दिलाई. आरटीआई और नागरिक अधिकार कार्यकर्ता अंजलि भारद्वाज और सतर्क नागरिक संगठन की अमृता जौहरी ने सिन्हा की नियुक्ति और सीआईसी में तीन अन्य सूचना आयुक्तों की नियुक्ति के कदम का स्वागत करते हुए कहा कि बिना प्रमुख के आयोग का कामकाज गंभीरता से प्रभावित हो रहा था. जबकि, इससे पहले केंद्रीय सूचना आयोग बिना प्रमुख के ही संचालन कर रहा था और इसके कर्मचारियों की संख्या पचास फीसदी से भी कम है.
नए सूचना आयुक्त पत्रकार उदय माहुरकर, पूर्व श्रम सचिव हीरा लाल समारिया और
पूर्व उपनियंत्रक एवं महालेखा परीक्षक सूरज पुन्हानी ने भी अपना पदभार संभाल लिया
है. कार्यकर्ताओं का आरोप है कि सीआईसी में नियुक्तियों के लिए चुनाव प्रक्रिया
में पारदर्शिता की कमी है, जिससे
जनता के बीच संदेह पैदा हुआ है और संस्था में विश्वास कम हुआ है. उनहोंने विपक्ष
के नेता अधीर रंजन चौधरी का चुनाव समिति की बैठक के दौरान असहमित नोट देने का
मुद्दा भी उठाया. इसके साथ ही सुप्रीम कोर्ट के निर्देशों का पालन नहीं करने का
मुद्दा भी उठाया. इस समिति की अध्यक्षता प्रधानमंत्री ने की थी. उन्होंने कहा कि
नियुक्त किए गए सूचना आय़ुक्तों में से एक ने रिक्त पद के लिए दिए गए विज्ञापन पर
आवेदन भी नहीं किया था और उनका नाम एकाएक सामने आ गया. द वायर ने इससे पहले इस
मुद्दे पर हुए हंगामे पर रिपोर्ट भी प्रकाशित की थी कि चुनाव समिति ने भाजपा के
समर्थक और पत्रकार को बतौर सूचना आयुक्त नियुक्त किया और सीआईसी प्रमुख पद के लिए
सबसे वरिष्ठ केंद्रीय सूचना आयुक्त की अनदेखी की.
सभी पदों पर नियुक्त नहीं हुई
नागरिक अधिकार कार्यकर्ताओं का कहना है
कि वे इस बात से निराश हैं कि सीआईसी में सभी खाली पदों पर नियुक्तियां नहीं की
गई. सीआईसी के प्रमुख बिमल जुल्का की 26 अगस्त 2020 को सेवानिवृत्ति के बाद और सितंबर 2020 के अंत में एक अन्य आयुक्त के पद से
हटने के बाद आयोग के प्रमुख सहित छह पद खाली पड़े थे. यहां तक कि चार पदों पर
नियुक्ति के बाद तीन पद अभी भी खाली हैं क्योंकि आयोग में सिन्हा पहले सूचना
आयुक्त के पद पर थे.
उन्होंने बयान में कहा, सूचना आयुक्त पदों पर तीन और खाली पद
हैं. यह दुर्भाग्यपूर्ण है कि निवर्तमान आयुक्तों के नियमित सेवानिवृत्ति की वजह
से बढ़ रहे खाली पदों के बावजूद केंद्र सरकार आयुक्तों की समय पर नियुक्ति में
लगातार असफल हो रही है. इन्होंने कहा कि मौजूदा समय में सीआईसी के समक्ष 37,000 से अधिक अपीलें और शिकायतें लंबित हैं
और सुप्रीम कोर्ट के समक्ष त्वरित सुनवाई के लिए दायर किए गए आवेदन के बाद
नियुक्तियां की गईं.
नियुक्ति
प्रक्रिया पारदर्शी नहीं
सुप्रीम कोर्ट के समक्ष मामले में
याचिकाकर्ताओं ने कहा कि नियुक्ति प्रक्रिया को पारदर्शी बनाने के सुप्रीम कोर्ट
के निर्देशों का उल्लंघन हुआ है. याचिकाकर्ताओं ने कहा कि सुप्रीम कोर्ट ने फरवरी 2019 के अपने फैसले (अंजलि भारद्वाज बनाम
अन्य बनाम केंद्र सरकार) में नियुक्ति प्रक्रिया को पारदर्शी बनाने के निर्देश दिए
थे. याचिकाकर्ताओं ने कहा, यह
निर्देश दिए जाते हैं कि खोज एवं चयन समितियों के सदस्यों के नाम, एजेंडा और समिति की बैठकों के मिनट्स, पदों के लिए जारी विज्ञापन विशेष रूप
से आवेदक, शॉर्टलिस्ट
किए गए उम्मीदवारों के नाम, फाइल
नोटिंग और नियुक्ति से संबंधित पत्राचार आदि को सार्वजनिक डोमेन में रखा जाना
चाहिए.
दोनों कार्यकर्ताओं ने कहा कि अदालत ने
अपने अंतिम निर्देशों में कहा था, खोज समिति
के लिए यह उचिता होगा कि वह उम्मीदवारों को शॉर्टलिस्ट करने के लिए मानदंड बनाएं
ताकि यह सुनिश्चित किया जा सके कि ऑब्जेक्टिव और तर्कसंगत मापदंड के आधार पर
शॉर्टलिस्टिंग को सुनिश्चित किया जा सके. उन्होंने कहा कि सुप्रीम कोर्ट के
निर्देशों के विपरीत सिर्फ रिक्त पदों के लिए विज्ञापन ही सार्वजनिक डोमेन में है.
मापदंड सहित अन्य जानकारी किसी को नहीं पता है. उन्होंने कहा कि वास्तव में
कार्मिक एवं प्रशिक्षण विभाग (डीओपीटी) ने आरटीआई के तहत इसकी जानकारी देने से
इनकार कर दिया.
भारद्वाज और जौहरी ने कहा, आरटीआई एक्ट 2005 की धारा 8(1) के तहत उम्मीदवारों की संबंधित जानकारी
को छूट दी गई है. चूंकि अभी चुनाव की प्रक्रिया का पूरा होना बाकी है इसलिए मांगी
गई जानाकरी को पेश करना अनुकूल नहीं है. सरकार में अन्य उच्चस्तरीय पदों पर
नियुक्तियों में भी इस तरह की जानकारी को उजागर नहीं किया जाता. @Nayak 1
Not all vacancies in Central Information Commission have been appointed

The two petitioners, who have filed a petition in the Supreme Court
against the delay in the appointment of Information Commissioners (IC), have
welcomed the appointment of Yashvardhan Kumar Sinha as the Chief Information
Commissioner of the Central Information Commission (CIC). Sinha was administered
the oath of office by President Ram Nath Kovind on Saturday. RTI and civil
rights activist Anjali Bhardwaj and Amrita Johri of the vigilante civic
organization welcomed the move to appoint Sinha and the appointment of three
other information commissioners in the CIC, saying that the functioning of the
commission without a chief was being seriously affected. Whereas, earlier the
Central Information Commission was operating without a chief and its staff
strength is less than fifty percent.
New Information Commissioner journalist Uday Mahurkar, former Labor
Secretary Heera Lal Samaria and former Sub-Inspector and Auditor General Suraj
Punhani have also taken over. The activists allege that there is a lack of
transparency in the election process for appointments in the CIC, which has
raised suspicion among the public and reduced trust in the institution. He also
raised the issue of giving a dissenting note to the Leader of the Opposition,
Adhir Ranjan Chaudhary during the election committee meeting. Along with this,
the issue of not following the instructions of the Supreme Court was also
raised. This committee was chaired by the Prime Minister. He said that one of
the appointed information commissioners had not even applied for the
advertisement given for the vacant post and his name suddenly came to the fore.
The Wire had earlier published a report on the uproar on the issue that the
Election Committee appointed a BJP supporter and journalist as Information
Commissioner and ignored the most senior Central Information Commissioner for
the post of CIC.
Not appointed to all positions
Civil rights activists say they are disappointed that appointments were
not made to all vacant posts in the CIC. After the retirement of CIC chief
Bimal Julka on 26 August 2020 and the removal of the post of another
Commissioner at the end of September 2020, six posts, including the head of the
Commission, were lying vacant. Even after the appointment to four posts, three
posts are still vacant because Sinha was earlier in the commission as the
information commissioner.
He said in the statement, there are three more vacant posts on the
information commissioner posts. It is unfortunate that despite the vacant posts
rising due to the regular retirement of the outgoing commissioners, the central
government is continuously failing in the timely appointment of commissioners.
He said that at present there are more than 37,000 appeals and complaints
pending before the CIC and the appointments were made after the application
filed for speedy hearing before the Supreme Court.
Appointment process not transparent
In the case before the Supreme Court, the petitioners said that the
instructions of the Supreme Court to make the appointment process transparent
has been violated. The petitioners said that the Supreme Court in its judgment
of February 2019 (Anjali Bhardwaj vs others vs Central Government) had directed
to make the appointment process transparent. The petitioners said, it is
directed that the names of the members of the search and selection committees,
agendas and minutes of committee meetings, advertisements issued for the posts,
especially the applicants, the names of the shortlisted candidates, file noting
and appointment related Correspondence etc. should be kept in public domain.
The two activists said that the court had said in its final instructions
that it would be appropriate for the search committee to set criteria for
shortlisting candidates to ensure that shortlisting was done on the basis of
objective and rational criteria. Could. He said that contrary to the
instructions of the Supreme Court, only the advertisement for vacancies is in
the public domain. Nobody knows other information including criteria. He said
that in fact the Department of Personnel and Training (DoPT) refused to give
information under RTI.
Bhardwaj and Johri said, under Section 8 (1) of the RTI Act 2005,
related information of the candidates has been exempted. Since the election
process is yet to be completed, it is not favorable to present the information
sought. Such information is also not disclosed in appointments to other high
